A proposed Settlement has been reached relating to a class action lawsuit brought by Plaintiff, a student at LVC during the Spring 2020 semester, against LVC, on behalf of a putative class who paid tuition and/or fees for the Spring 2020 semester. The case is captioned Alunni v. Lebanon Valley College, Case No. 1:23-cv-01424 (M.D. Pa.) (the “Action”).
In this Action, Plaintiff alleged LVC breached a contract or was unjustly enriched when it transitioned to remote learning in response to the COVID-19 pandemic. LVC denies all allegations of wrongdoing and there has been no finding of liability in any court. However, considering the interest of both LVC and its students in prompt resolution of the matter, LVC and Plaintiff have agreed that LVC will pay $575,000.00 into a Settlement Fund to resolve the Action.
The terms of the agreement are set forth in the proposed Settlement that must be approved by the United States District Court for the Middle District of Pennsylvania. This notice includes information about the proposed Settlement, a final approval hearing scheduled by the Court, and the process for being heard by the Court.
